German courts also find inadmissible defeat devices at Daimler
The Regional Court of Stuttgart (decision of the Regional Court of Stuttgart) awarded damages of EUR 25,000.00 to EUR 40,0000.00 to the plaintiff owners of Mercedes-Benz vehicles in three cases.
The Regional Courts in Hanau and Karlsruhe had also already ruled in favour of the affected vehicle owners in 2018. In its decision, the Regional Court of Stuttgart clearly stated that the technology used by Daimler, which throttles the exhaust gas purification at certain temperatures, was an inadmissible defeat device.
Like the Regional Court of Stuttgart, the German Federal Motor Transport Authority (KBA) assessed the technology used by Daimler. Daimler appealed against all decisions.
